DUI not being charged in Wichita, Kansas?
I have received a DUI in Wichita Kansas in July of 2006, went to court for the first time but the charges had not been filed yet. It is my first time ever and I have the diversion papers, but they will not let me file them until I am charged. They are supposed to let me know when that happens, but as of now I have not heard. I do not want to draw attention to it if they are just sitting on it but then again I would like to know what I am looking at as far as cost and classes. How can I find out about that or get some idea as to what will happen next? I cannot afford an attorney and do not feel it will be advantageous to me to try to get one as I know I was in the wrong. I just dont like being left out in the cold.
Although I do not necessarily agree with the previous poster’s assertions regarding the consequences of not having a lawyer, it is always best to have one with this kind of charge due to the possible consequences not only from the court system, but insurance, etc. Even if you were in the wrong, you want to make sure that you are getting the best result possible, and you will not know that without an attorney. If you cannot afford an attorney, ask the court to appoint one for you after the charges are filed.
But, your instincts are correct. You want to keep informed as to whether a charge was filed, so that a warrant is not issued for your arrest, but you do not want to be such a pest that they notice a case they may not have otherwise filed. Do make sure that the court or prosecutor has your correct address so they can notify you when and if charges are filed.
Do not participate in any kind of “diversion” program now. You will most likely not get credit for it after charges are filed.
