Affidavits in Texas…?
Yesterday we have submitted paperwork to rebut the defense’s motion for suppression argument on a DUI case. On their paperwork they had the attorney, the defendant’s signature, and a notary public official. We were late turning in our response and our argument, however, the judge allowed us the opportunity to turn the rough draft and a last minute affidavit. Now what’s signed on it is my signature, and the notrary official. Have we forgotten anything else? Should we have gotten the arresting officer’s signature? Or are we good. The judge is reviewing both arguments and he will make a ruling. Was it necessary for us to get the police officer’s signature to make it valid? Thanks…..
The arresting officer should sign it if he is testifying to any of the facts in the affidavit.
